One area of particular interest, in which our litigation experts practice has gained huge experience over the years, is pre-emptive measures in the contexts of cross border commercial disputes, allowing the freezing of assets at a global level (mareva injunctions) but also discovery orders against any party involved (willingly or not) in any wrongdoing, such as banking institutions or nominee service providers, thus allowing access to information which will facilitate the enforcement of interim orders or the filing of a new action against the actual wrongdoer.

What is also noteworthy is that our practice is among the very few firms which now have expertise in dealing with the division of family property within the contexts of foreign divorce proceedings, involving foreign individuals, but with assets held through complex corporate structures in Cyprus, thus giving a unique opportunity for family law practitioners and commercial litigators to join forces.

Overall the firm’s litigation and arbitration practice deals with both local and international clients and cases having an international law element. Some of the firm’s biggest clients are in fact foreign and local banks in pursue of enforcement of credit facility agreements and securities, but at the same time we represent several other local businesses  in cases involving breach of contractual obligations or offering assistance in debt collection.

Our international clientele includes multinational companies or their ultimate beneficiaries being high profile individuals, trying to protect their interests, usually held though Cyprus based companies. Such disputes may be based, inter alia, on breach of contractual obligations under shareholders’ agreements, breach of fiduciary duties, but in certain cases, breach of constructive trust. In addition, we have acted as counsels in international arbitrations as well as filed actions in Cyprus, in aid of international arbitrations or ancillary to actions filed abroad. Furthermore we represent foreign banks in their efforts to protect or enforce securities granted either by Companies in Cyprus or foreign companies using assets located in Cyprus and have vast experience in bankruptcy and winding up proceedings as well as any liquidation related court proceedings.
